1. Introductory Provisions

1.1. These terms and conditions (hereinafter referred to as “terms and conditions”) of Karlovarská sůl s.r.o., with registered office at Na Výhledě 1076/3C, Stará Role, 360 17 Karlovy Vary, identification number: 11669403, registered in the Commercial Register maintained by the Regional Court in Plzeň, Section C, Insert 41003 (hereinafter referred to as “the seller”), regulate, in accordance with § 1751 (1) of Act No. 89/2012 Coll., the Civil Code, the mutual rights and obligations of the contracting parties arising on the basis of a purchase contract (hereinafter referred to as the “purchase contract”) concluded between the seller and another individual (hereinafter referred to as the “buyer”) via the seller’s online store. The online store is operated on the website www.carlsbad-salt.com.

1.2. These terms and conditions do not apply to cases where a person purchasing goods from the seller acts within the scope of their business activity or profession.

1.3. Deviating provisions in the purchase contract take precedence over the terms and conditions.

1.4. The terms and conditions are an integral part of the purchase contract. The purchase contract and the terms and conditions are prepared in the Czech language.

1.5. The seller may amend or supplement the wording of the terms and conditions. This does not affect rights and obligations arising under the previous version of the terms and conditions.

2. User Account

2.1. Based on the buyer’s registration on the website, the buyer can access their user interface. The buyer can order goods from here. Orders can also be placed without registration.

2.2. The buyer must provide accurate and truthful information, which must be updated in case of any changes.

2.3. Access to the user account is protected by a username and password, which the buyer must not share with third parties.

2.4. The seller may cancel the user account if the buyer has not used it for more than two years or if the buyer violates their obligations under the purchase contract.

2.5. The buyer acknowledges that the user account may not be available continuously due to maintenance.

3. Conclusion of Purchase Contract

3.1. The presentation of goods on the online store’s interface is informative and is not an offer to enter into a contract.

3.2. The online interface contains information about goods, prices, packaging, and delivery costs, including any free delivery offer for orders meeting a specified minimum value.

3.3. The order is placed through an electronic form on the website, and the buyer has the option to review and modify details before submitting the order.

3.4. The seller is entitled to request additional order confirmation.

3.5. The contractual relationship is established upon the seller’s acceptance of the order, sent to the buyer’s email address.

3.6. The buyer bears the costs associated with the use of remote communication means.

4. Price of Goods and Payment Terms

4.1. The price of goods and any delivery costs can be paid as follows:

  • in cash at the seller’s addressin cash at the seller’s address 
  • by cash on delivery
  • by bank transfer to the seller’s account 
  • by credit card
  • upon personal pickup

4.2. Prices remain valid while displayed on the online store’s interface.

4.3. Non-cash payments are due within seven days of concluding the purchase contract.

5. Withdrawal from Purchase Contract

5.3. The buyer may use the template form provided by the seller to withdraw from the purchase contract. The withdrawal must be sent to the seller’s business address or the email address info@carlsbad-salt.com.

5.4. In the event of withdrawal from the purchase contract, the seller will refund the purchase price without undue delay, no later than 14 days from receipt of the returned goods or proof that the goods have been sent back.

5.5. The seller reserves the right to offset claims for compensation for damages caused to the goods against the buyer’s claim for a refund of the purchase price.

6. Transport and Delivery of Goods

6.1. The method of transport is determined based on the buyer’s requirements. In the case of a special delivery method chosen by the buyer, the buyer bears any additional costs associated with this delivery.

6.2. The buyer is obliged to take over the goods upon delivery to the address specified in the order.

6.3. If the goods are not taken over during delivery, the seller has the right to demand reimbursement for the costs of repeated delivery.

6.4. Upon receipt of the goods from the carrier, the buyer is obliged to check the package. In case of damaged packaging or goods, it is necessary to inform the carrier and potentially refuse the shipment.

7. Rights from Defective Performance

7.1. The rights and obligations of the contracting parties regarding rights from defective performance are governed by relevant legal provisions, particularly §§ 1914 to 1925 and §§ 2099 to 2117 of the Civil Code.

7.2. The seller warrants that the goods are free from defects upon receipt and conform to the agreed description, quality, and characteristics.

7.3. In case of defective performance, the buyer is entitled to a repair, delivery of new goods, a reasonable discount, or withdrawal from the contract, depending on the nature of the defect.

7.4. The buyer must file a complaint with the seller without undue delay upon discovering the defect.

8. Other Rights and Obligations of the Contracting Parties

8.1. The buyer acquires ownership of the goods by paying the full purchase price.

8.2. Complaints are handled by the seller via email at info@carlsbad-salt.com.

8.3. In case of an out-of-court settlement, the buyer may contact the Czech Trade Inspection Authority or the European Consumer Centre of the Czech Republic.

9. Personal Data Protection

9.1. The seller fulfills the information obligation toward buyers in accordance with Article 13 of the GDPR Regulation and processes the buyer’s personal data for the purposes of fulfilling the purchase contract, negotiating the contract, and fulfilling legal obligations.

10. Sending Commercial Communications and Cookies

10.1. The buyer agrees to receive commercial communications from the seller via email or phone.

10.2. The seller fulfills legal obligations regarding cookie storage in accordance with applicable legal regulations.

11. Delivery

11.1. Notifications may be sent to the buyer’s email address specified in the user account or order.

12. Závěrečná ustanovení

12.1. The legal relationship between the seller and the buyer is governed by Czech law.

12.2. If any provision of the terms and conditions is invalid or ineffective, its invalidity does not affect other provisions.

12.3. The purchase contract and terms and conditions are archived by the seller in electronic form and are not accessible.
